USA –-(Ammoland.com)- States that uphold the Duty to Retreat, reason that a person who is under imminent threat of personal harm must retreat from the threat as much as possible before responding with force.
States that uphold Stand Your Ground laws generally state that, under certain circumstances, individuals can use force to defend themselves without first attempting to retreat from the danger. The purpose behind these laws is to remove any confusion about when individuals can defend themselves and to eliminate prosecutions of people who legitimately used self-defense even though they had not attempted to retreat from the threat.
But then law is not quite so simple, nor is it uniform in all 50 states. States with Stand Your Ground Laws in some states may require a duty to retreat before any lethal force is involved, while others may have certain limitations as to when lethal force can be used i.e.: only on your own property etc. and still others remove the duty to retreat altogether. It’s always best to learn your state laws when carrying and using a gun in any fashion!
