NY State To Take Over Gun & Ammo Background Checks Costing You Money & Privacy

A New York State law that will require background checks for ammunition purchases will go into effect on September 13, 2023, and it is going to cost you money and privacy.

The New York State Police Department will handle this new background check system. Not only will the State Police be handling the background checks for ammunition, but they will also now be handling all background checks for New York firearm purchases. Background checks typically go through the Federal Government, where a gun registry is illegal. New York State has now taken over the background check system for all NY gun purchases, bypassing the Federal Government and sending private and personal information directly to the New York State Police Department.

To fund this new program, the State of New York will be requiring firearm purchasers to pay $9 for their own firearm background check and $2.50 for each ammunition background check. Besides the burden of additional costs for the privilege of being infringed upon, FFLs and gun owners have other concerns with this new legislation. Some of those include the possibility of purchase delays, poor handling of critical data, and the concern that New York State will be building a database of gun owners to be used for future confiscations or harassment.

The plaintiffs in the Gazzola v. Hochul lawsuit filed an Emergency Motion on August 29, 2023, to the Second Circuit Court of Appeals in Manhattan, seeking an immediate injunction to stop the Governor and the NYS Police from their intended take-over of the firearms background check system, the launch of the ammunition background check system, and the investigation of federally-licensed dealers in firearms through the NYSP “Joint Terrorism Task Force.”

According to Attorney Paloma A. Capanna, “Governor Hochul has made clear that she will use a state background check system to create a gun owners’ registry – the first of its kind in the history of this nation. Acting Superintendent Nigrelli made clear he will have “zero tolerance” for anyone violating the new laws, and that means dealers with retail space in New York face imminent arrest since the investigations started on July 25, 2023.”

We saw Kathy Hochul defy the Constitutional rights of New York State Residents when she implemented the CCIA immediately after the Bruen decision.

Why would she not defy New York State residents’ rights to privacy by creating a gun registry through this new New York State-controlled background check process?

Matt Mallory is the owner of PS&Ed (Public Safety and Education), a Type 07 Class 02/SOT FFL/Gun Store in Upstate NY. According to Matt, during the process of registering his FFL for the new State background check system, he received a message from the NY State Trooper NICS department and was asked to call them back and speak with “agent 320”. The agent would not provide his name to Matt when asked.

Mr. Mallory said, “This appears to be a way for the State and their employees to stay anonymous while dealing with legal and fully compliant NY State Gun Stores! It must be nice that they can hide behind a number when FFLs are exposed to anyone that wants to target or sue us for dealing in legal products.”

The New York State Extreme Risk, Protection, Order, a.k.a. Red Flag Law, allows for the confiscation of guns without due process. Many people are concerned that this new background check scheme, with the potential to double as a gun registry, is designed to work in conjunction with New York State’s Red Flag Law because before you can confiscate guns, you need to know where they are located.

Attorney Paloma Capanna said, Calling all federal firearms licensees in New York to go on strike on Wednesday, September 13, 2023 by closing their front doors and refusing to transmit gun owner information to the Governor and the State Police. We’re asking Citizens to stand in solidarity with their local FFLs by firing a single shot at their local rod & gun clubs and ranges to create a “Shot Heard ‘Round the State” on that same day, at high noon. This “Strike & Shoot” is unprecedented in the history of our country. This is our Boston Tea Party.”

SAFESHOOT Shooting Sports Complex will be holding a “Strike and Shoot” event for gun owners to express their disapproval of this new policy. The event will be held at the SAFESHOOT Facility on September 13, 2023, at 10 Kieffer Lane, Kingston, NY 12401

The 2nd Amendment is not a privilege. It’s your right.
