Michigan –-(Ammoland.com)- Recently a member of our Facebook group was at Lake Alliance Park to do a little fishing with his son. The father was Open Carrying his pistol. They were approached by a law enforcement officer and told to leave or be charged with obstruction. Apparently the law enforcement officer was unaware of MCL 123.1102, which states:
A local unit of government shall not impose special taxation on, enact or enforce any ordinance or regulation pertaining to, or regulate in any other manner the ownership, registration, purchase, sale, transfer, transportation, or possession of pistols or other firearms, ammunition for pistols or other firearms, or components of pistols or other firearms, except as otherwise provided by federal law or a law of this state.
Therefore, ordinances which prohibit the possession or carry of firearms in public are null and void. This also applies to City/Township/County owned parks and facilities.
Michigan Open Carry, Inc. has decided to have an awareness picnic. We will be gathering at Lake Alliance Park starting at 2:00PM. Lake Alliance Park is located on Alliance Drive, Potterville MI.
MOC is covering the cost of the Shelter Rental. A few members are donating the hot dogs, burgers and beverages, but we recommend those attending to bring a dish to share. This is NOT a requirement to attend the picnics.
Michigan Open Carry Leadership will be in attendance. The local police chief has been friendly and is going to try to attend. The carrying of a firearm is recommended but NOT required.
