A man who was mistakenly released from a Colorado prison 90 years early then re-incarcerated is now fighting for his freedom again, this time through Immigration and Customs Enforcement, as he’s currently being held over his immigration status instead of over his early release.
Rene Lima-Marin was sentenced to serve 98 years in prison for the armed robberies of two video stores back in 1998. But due to a paperwork error, Lima-Martin was released in 2008 and it wasn’t until 2014 that officials realized their mistake.
However, during those six years outside of the prison walls, Lima-Martin lived a relatively normal life. He got married, had kids, held a steady job and even worked with area youth, helping them to see the impact of their life decisions.
But when the mistake was realized, Lima-Martin was taken back to prison to serve the rest of his sentence. However – seeing that Lima-Martin had become a productive member of society – a judge granted him his freedom once again.
Then ICE got involved.
As it turns out, Lima-Martin is not a legal U.S. citizen. He came to America from Cuba with his family as a refugee when he was just 1-year-old and the family never got green cards because they never intended to stay in the country permanently.
And here’s where it gets even more complicated.
While Lima-Martin was accidentally set free from prison, he routinely checked in with immigration. It wasn’t until after he was re-incarcerated and missed his check-ins that ICE took notice. Now, while the judge said let him go, ICE says no, and Lima-Martin as well as his family, are unsure what will happen from here, but he currently remains in ICE custody.
